Terms of Service

By accessing our website or purchasing our services, you agree to the following terms.

1. Services

Heartwood Digital provides web design, managed hosting, and website maintenance services to clients in Canada. All services are subject to a separate written agreement or proposal signed by both parties.

2. Payment

Payment terms are specified in your service agreement. Web design projects typically require a 50% deposit before work begins, with the remainder due upon completion. Managed hosting and maintenance services are billed monthly in Canadian dollars.

3. Intellectual Property

Upon receipt of final payment, clients receive full ownership of their website content and design assets created specifically for them. Heartwood Digital retains the right to display the work in its portfolio unless otherwise agreed in writing.

4. Hosting & Uptime

Heartwood Digital targets 99.9% uptime for managed hosting clients but does not guarantee uninterrupted service. Scheduled maintenance is performed with advance notice where possible.

5. Limitation of Liability

Heartwood Digital's liability for any claim arising from our services is limited to the amount paid by the client in the three months preceding the claim.

6. Governing Law

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein.
